What is a restraining order?

A restraining order is issued by a court to protect an individual from being abused, harassed, or stalked by another. The person being restricted is the “restrained person” and the one being defended is the “protected person”. There are many different types of restraining orders, each for a different situation. These include Domestic Violence, Dependent Adult Abuse, Workplace Violence, and Civil Harassment Restraining Orders.

The majority of restraining orders are issued by a court and begin when an individual seeks protection and requests it. Their duration can vary depending on the severity of the situation and a variety of other variables.

An Emergency Protective Order takes into effect immediately and typically lasts less than a week, while a Permanent Restraining Order can last a set number of years and can be extended by the protected person.
